High court suspends 3 MPO against Pervez Lal

MINGORA: Peshawar High Court (PHC) Mingora bench (Darul Qaza) on Tuesday suspended the arrest order under 3 MPO of Pervez Lal which was issued by the district administration of Upper Chitral on September 8.

The order was issued by the deputy commissioner of Upper Chitral on the allegation that Pervez Lal was involved in activities detrimental to the peace of the area.

The DC also ordered shifting of Pervez Lal to the Dera Ismail Khan jail for one month under the MPO.

Though the police could not arrest Mr Pervez, his counsel Rahimullah Advocate challenged the arrest order under 3 MPO in Darul Qaza on Sept 9, which today suspended it, a source told ChitralToday.

A bench of the court, comprising Justice Ishtiaq Ibrahim and Justice Waqar Ahmed, also directed the advocate general office to file a detailed reply to the petition by September 29.

It may be noted that the DC had issued the arrest order of Pervez Lal under 3 MPO after the latter in a speech during a protest criticized the administration for its failure to help the flood-affected people of Reshun.

Social media users had condemned the move and demanded withdrawal of the arrest order.

Two members of the KP assembly belonging to the PPP also submitted call attention notices in the house against the order.

The PHC a few years back had warned DCs across the province against misusing section 3 of the MPO under which anyone can be detained if they are a threat to peace.
