PESHAWAR: The Peshawar High Court on Wednesday evening restored the decision of the Election Commission of Pakistan to take back the election symbol of \’Bat\’ from the embattled PTI.
On December 22, the ECP took back the election symbol of the PTI for its failure to hold the intra-party in accordance with its constitution.
The PTI filed a petition in the PHC which on December 26 suspended the decision of the election commission.
Justice Ejaz Khan of the high court took up the appeal of the election commission against the stay during which the lawyers of the PTI and the ECP appeared and gave arguments.
At the outset, PTI counsel Qazi Anwar asked if the ECP could approach the high court against the court verdict.
The petition of the commission is not legal and the commission has also not uploaded the certificate of the intra-party election of the PTI, he contended.
Justice Khan asked if he had filed a contempt case against the commission. The counsel said the nomination papers of many PTI candidates had been rejected and the commission did nothing.
The ECP lawyer objected to the December 26th decision of the high court without hearing the PTI.
After hearing the two sides, the court reserved its judgement and later announced it, restoring the Dec 22 decision of the ECP to take back the election symbol of the PTI.
