Stay in land settlement record transfer extended

PESHAWAR: A bench of the Peshawar High Court (PHC) on Wednesday extended the stay in handing over of land settlement record of Chitral to the revenue department.

The Chitral land settlement case came up for hearing before a divisional bench of Justice Ishtiaq Ibrahim and Justice Abdul Shakur.

Additional Advocate General Atif Ali Khan pleaded before the bench for the vacation of the injunction already granted by the PHC which prevents closing of the settlement process and handing over of the settlement record to the senior Member Board of Revenue and other respondents in the case.

Barrister Asad-ul-Mulk objected to the vacation of the injunction stating that if the government was truly interested in the vacation of the stay it should submit its comments in the case where after the case will be argued, and if found bereft of merit then dismissed.

He implored that vacation of the interim relief already granted would render the petition infructuous.

Justice Ishtiaq Ibrahim stated that the case obviously had significance otherwise why would the Chief Justice transfer it from Dar-ul-Qaza Swat to the principal seat of the high court in Peshawar and thus it could not be allowed to become infructuous.

The bench extended the injunction already granted and directed the additional advocate general to personally ensure that the government files its comments before the next date of hearing.
